This User Agreement (the "Agreement") and the policies referred to herein contain the complete terms and conditions that apply to your use of the e-mail forwarding (the "Service") provided by CustomAddresses.com. By clicking on the "I Agree/Submit Now" payment button you are stating your agreement to all of the terms and conditions set forth herein. CustomAddresses.com reserves the right to modify this Agreement's terms and conditions at any time by informing you of the amended terms in a manner of our choosing, including posting them on our website or sending you e-mail. Continued use of the Service after a change of this Agreement or after implementation of a new policy constitutes acceptance of such change or policy.

 
1. SERVICE

CustomAddresses.com provides the Service to you for the purpose of assisting you in managing and changing e-mail addresses. CustomAddresses.com collects your e-mail at your old e-mail address, re-addresses the e-mail, and forwards the e-mail to your new e-mail address.

 
2. USAGE GUIDELINES

The Service is being offered to you for your personal and/or commercial use. Any other use which is unlawful or in violation of this Agreement's terms and conditions is prohibited. You are responsible for obtaining and for paying all applicable fees, taxes and costs of the Internet Service Provider (ISP) accounts. Both the new and old ISP accounts must be active during the service. Either you or CustomAddresses.com may terminate the Service at any time, for cause or no cause, with or without written notice. Your only right with respect to any dissatisfaction with the Agreement or the Service is to terminate your use. We reserve the right to set limits on the service which may include limits on the frequency of e-mail retrieving and rerouting, the number of messages, message size and length of service term at any time and at our sole discretion.

 
3. PRIVACY POLICY

CustomAddresses.com is committed to safeguarding your privacy online. Please refer to our separate Privacy Policy for further details.

 
4. GRANT OF RIGHTS TO USER

All text, graphics, data or other content on the CustomAddresses.com is provided to User by CustomAddresses.com for the sole purpose of using the Service. User shall not copy, display, modify, create derivative works of, publish, or sell the CustomAddresses.com content or any information, software, or services provided by CustomAddresses.com hereunder. The CustomAddresses.com content may be modified from time to time by CustomAddresses.com in its sole discretion. Except as expressly set forth herein, no license is granted to User for any other purpose, and any other use of the Service or the CustomAddresses.com content by User shall constitute a material breach of this Agreement. 5. LIABILITY LIMITATIONS

IN NO EVENT SHALL CustomAddresses.com BE LIABLE FOR ANY INJURY, LOSS, CLAIM, DAMAGE OR ANY SPECIAL, EXEMPLARY, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND, WHETHER BASED IN CONTRACT, TORT OR OTHERWISE, WHICH ARISES OUT OF OR IS ANY WAY CONNECTED WITH (I) ANY USE OF THE SERVICE, CustomAddresses.com SITE OR CustomAddresses.com CONTENT, (II) ANY FAILURE OR DELAY (INCLUDING, BUT NOT LIMITED TO, THE USE OR INABILITY TO USE ANY COMPONENT OF THE SERVICE OR THE CustomAddresses.com SITE FOR SUBSCRIPTIONS), OR (III) THE PERFORMANCE OR NONPERFORMANCE OF ANY INTERNET SERVICE PROVIDER IN CONNECTION WITH THE SERVICE.

 
6. DISCLAIMER OF WARRANTY

THE INFORMATION, PROGRAMS, PRODUCTS, AND MATERIALS CONTAINED IN OR ACCESSED ON THE CustomAddresses.com SITE, INCLUDING, WITHOUT LIMITATION, THE SERVICE AND THE CustomAddresses.com CONTENT, ARE PROVIDED TO USER ON AN 'AS IS' BASIS AND WITHOUT WARRANTY OF ANY KIND. CustomAddresses.com DISCLAIMS ALL WARRANTIES, EXPRESSED OR IMPLIED, WITH RESPECT TO THE SERVICE, THE CustomAddresses.com SITE, THE CustomAddresses.com CONTENT AND RELATED MATERIALS PROVIDED HEREUNDER INCLUDING, WITHOUT LIMITATION, ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT OR ARISING FROM A COURSE OF DEALING.

8. SEVERABILITY

If any of the provisions, or portions thereof, of this Agreement are found to be invalid under any applicable statute or rule of law, then, that provision notwithstanding, this Agreement shall remain in full force and effect and such provision or portion thereof shall be deemed omitted.

 
9. NO ASSIGNMENT

This Agreement and the rights granted and obligations undertaken hereunder may not be transferred, assigned or delegated in any manner by User, but may be so transferred, assigned or delegated by CustomAddresses.com.

 
10. WAIVER

Any waiver of any provision of this Agreement, or a delay by any party in the enforcement of any right hereunder, shall neither be construed as a continuing waiver nor create an expectation of non-enforcement of that or any other provision or right.

 
11. JURISDICTION

This Agreement is made under and shall be governed by and construed in accordance with the laws of State of Arizona, USA, without regard to any choice of law provisions. The parties hereby consent to the jurisdiction of the state and federal courts located in Scottsdale, Arizona, USA.
